Acceptance of Terms

By accessing or using Titan Council (the “Platform”), you agree to be bound by these Terms and Conditions. If you do not agree to these terms in their entirety, you must not use the Platform. Your continued use of Titan Council after any updates to these Terms constitutes acceptance of the revised Terms.

These Terms constitute a legally binding agreement between you (“User”) and Titan Council (“we”, “us”, or “our”). If you are using the Platform on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms.

Eligibility

You must be at least 18 years old to create an account and use Titan Council. By creating an account, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.

Titan Council is not intended for use by children. We do not knowingly collect information from anyone under 18. If we become aware that an account has been created by someone under 18, we reserve the right to suspend or terminate that account.

Nature of the Service

Titan Council is an AI-powered coaching and accountability platform. The Titans — Leonidas, Marcus, Zara, and Zane — are artificial intelligence personas designed to provide motivational guidance, goal-setting frameworks, and general coaching support.

The Platform is intended to complement your personal development journey. It is not a substitute for professional medical, psychological, financial, legal, or nutritional advice. The guidance provided by Titan Council AI personas is general in nature and may not be appropriate for your specific circumstances.

Health, Fitness & Medical Disclaimer

Titan Council may provide guidance relating to fitness, exercise, nutrition, sleep, and general wellbeing. All such guidance is followed entirely at your own risk.

We strongly recommend that you consult a qualified medical professional before beginning any new exercise programme, diet, or significant lifestyle change, particularly if you:

• —Have a pre-existing medical condition, injury, or disability
• —Are pregnant, postpartum, or planning a pregnancy
• —Have not exercised regularly in the past six months or more
• —Are under 18 or over 65 years of age
• —Are taking prescription medication
• —Have a history of cardiovascular, respiratory, or musculoskeletal conditions
• —Have been advised by a doctor to limit physical activity

Any fitness or wellness content on this Platform is provided for informational and motivational purposes only. Titan Council, its founders, employees, AI systems, and affiliates accept no responsibility or liability for any injury, illness, adverse health outcome, or death arising directly or indirectly from following any coaching, exercise, nutrition, or wellness guidance provided through the Platform.

If you experience pain, dizziness, shortness of breath, or any unusual symptoms during exercise or following any advice provided on this Platform, stop immediately and seek medical attention.

Disclaimer of Liability

Nothing in this section limits or excludes any guarantee, right, or remedy you may have under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted, or modified. Subject to that, and to the maximum extent otherwise permitted by applicable law:

• —Titan Council and its AI coaching personas provide information on an "as is" basis without warranties of any kind, either express or implied.
• —We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.
• —We are not responsible for any decisions you make based on content provided by the Platform.
• —We expressly disclaim all liability for any direct, indirect, incidental, consequential, special, or exemplary damages arising out of your use of the Platform.
• —This includes, without limitation, loss of income, loss of opportunity, physical injury, psychological harm, or any other loss or damage of any nature.

Results mentioned in any testimonials, case studies, or example outcomes on the Platform are not typical and are not a guarantee of your own results. Individual outcomes will vary based on effort, circumstances, and many factors outside our control.

Fair Use Policy

Titan Council operates a Fair Use Policy to ensure a high-quality, stable experience for all users.

Program Generation Limits

Your subscription includes up to 8 AI-generated program generations per month, resetting on your monthly billing date.

To keep your coaching focused, you may run a maximum of 2 Mindset programs and 1 Health & Fitness program at the same time.

The following features are exempt from these limits and are always available regardless of usage:

• —Morning and evening briefings
• —Weekly, monthly, and quarterly progress reviews

Prohibited Use

• —Automated scraping, bulk querying, or programmatic use of the Platform
• —Sharing account credentials to circumvent per-user limits
• —Using the Platform to train, fine-tune, or build competing AI products
• —Attempting to extract, reverse-engineer, or reproduce the underlying AI system prompts or Titan personas
• —Any use that places unreasonable load on our infrastructure

We reserve the right to throttle, suspend, or terminate access to accounts that breach this Fair Use Policy, with or without notice, at our sole discretion.

User Accounts & Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorised use of your account. You are solely responsible for all activity that occurs under your account.

You agree not to use the Platform to:

• —Violate any applicable laws or regulations
• —Harass, threaten, or abuse the AI systems or attempt to manipulate them into producing harmful outputs
• —Impersonate any person or entity
• —Transmit any viruses, malware, or other malicious code
• —Attempt to gain unauthorised access to any part of the Platform or its underlying infrastructure

Subscription, Billing & Cancellation

Titan Council is offered on a recurring monthly subscription basis. By subscribing, you authorise us to automatically charge your nominated payment method at the start of each billing cycle until you cancel.

Your subscription will automatically renew each month unless cancelled before the next billing date. You may cancel at any time from your account settings; cancellation takes effect at the end of your current billing period, and you will retain access to the Platform until that date.

We do not provide refunds for partial billing periods, except where required by law. If you believe you have been charged in error, contact us at support@titancouncil.ai and we will review your request.

We reserve the right to change subscription pricing. If we do, we will provide reasonable notice before the change takes effect for existing subscribers.

Intellectual Property

All content on the Titan Council Platform — including but not limited to the Titan personas, their names, personalities, system prompts, artwork, UI design, copy, and branding — is the exclusive intellectual property of Titan Council. Nothing in these Terms grants you any rights to use our intellectual property without express written permission.

You retain ownership of any personal data, journal entries, goals, or content you create within the Platform. By using the Platform, you grant us a limited licence to process and store that content for the purpose of delivering the service to you.

Privacy

Your use of the Platform is also governed by our Privacy Policy. By using Titan Council, you consent to the collection, storage, and use of your data as described in that policy. We take data privacy seriously and will never sell your personal data to third parties.

AI conversations are processed via third-party AI providers (currently Anthropic). By using the coaching features, you consent to your messages being transmitted to Anthropic’s API for the purpose of generating responses. Please review Anthropic’s usage policies at anthropic.com.

Termination

You may stop using the Platform and cancel your subscription at any time via your account settings.

We may suspend or terminate your access to the Platform, with or without notice, if we reasonably believe you have breached these Terms, engaged in fraudulent or abusive conduct, or for any other reason at our discretion, including discontinuation of the Platform itself.

On termination, your right to access the Platform will cease. We may retain certain data as required by law or as described in our Privacy Policy, and may delete your data in accordance with that policy following termination.

Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We may also update these Terms from time to time. Continued use of the Platform following notification of changes constitutes your acceptance of the updated Terms.

We will make reasonable efforts to notify users of material changes to these Terms via email or in-app notification.

Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Australia.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
